Press Statement After The Council Of Governors Meeting, 9th January, 2017

The Council of Governors has agreed to postpone the 4TH Annual Devolution conference to 25th -28th April 2017, as opposed to the earlier decided date of 20-24 February 2017. The Conference will bring all the stake holders on board. This year’s devolution conference will be held in Nakuru County.
Resignation from office by public servants
All public servants at the Counties who intend to contest an election should resign from public office at least six month before the date of Election.
Security for state officers
The interior Cabinet secretary Joseph Nkaissery has withdrawn the security details of Mombasa Governor H.E Hassan Joho and Kilifi Governor H.E Amason Kingi without reasons.
Article 260 of the Constitution includes the office of the Governor as a state Office and subsequently Governors must before assuming the state office take and subscribe the oath of Office, which acts as the affirmative to the entire public that respective individual has been issued with responsibility to serve constituents and in the discharge of his duties, is entitled to benefits. This has been reiterated in section 30 of the County Governments Act. Consequently, the Salaries and Remuneration commission under Article 230(4)(a) of the Constitution, set security as one of the benefits to state Officers serving in the County Government vide Gazette Notice No 2888 of March, 2013. Actually, all state officers are entitled to Security.
The Council condemns the acts of the Cabinet Secretary and therefore intends to move to court for a declaration that this is unfounded and unconstitutional.
The Council is also seeking an appointment with the Excellency the president to discuss on this issue of withdrawal of security from Governors.
